Canadian punk princess Avril Lavigne is being sued by U.S. songwriters who claim that her smash hit `Girlfriend’ sounds suspiciously like a track they took up the charts in the 1970s.

Lavigne’s manager, Terry McBride, says the pop starlet is one of several people named in a lawsuit filed July 2 that alleges striking similarities to the Rubinoos song `I Wanna Be Your Boyfriend.’

The group’s founder, Tommy Dunbar, filed the suit in California’s Northern Federal District Court and also names Lavigne’s publishing company Avril Lavigne Publishing and Lavigne’s songwriting partner Dr. Luke as defendants.

McBride says from Vancouver that the claim is baseless, noting that a musicologist he hired to study both tracks has deemed them completely different songs.

Still, McBride, also CEO of Nettwerk Music Group, admitted that he is considering settling the suit out of court if the costs of defending the case prove too high.

The suit comes on the heels of a jab at Lavigne by fellow Canuck songstress Chantal Kreviazuk, who recently suggested to Performing Songwriter magazine that Lavigne stole one of her songs for the disc `The Best Damn Thing.’

I haven't heard the other song, but so many songs are extremely derivative of other songs and they don't get into legal hot water. It's just the way of the business, there are only so many chords, etc.

But i've never heard of the Chantal Kreviazuk thing. anyone have more details on that?!

In that case, the chorus completely and totally rips off "I Wanna Be Your Boyfriend". She should get sued for every cent!

I just heard the chorus of that Rubinoos song, and someone on Avril's side has some explaining to do. The "Hey hey! You you! I wanna be your boyfriend" part sounds exactly like Avril's chorus.

I always thought the hook was legally sampled as well. It was part of the charm of the song for me.

The two songs don't sound alike to me. Maybe the lyrics in the chorus are similar but in melody I can distinguish both.

Other than that one line in both songs even that is questionable I really fail to see what she stole i mean other than the line the melodies are completely different.

The Rubinoos lawsuit comes less than a month after Chantal Kreviazuk told Performing Songwriter magazine that she supplied Lavigne with the new song "Contagious" two years ago and was mighty surprised to see it show up on The Best Damn Thing with songwriting credits by Lavigne and Evan Taubenfeld.

Terry McBride (Lavigne's manager) said that Kreviazuk has since retracted her statement to the publication. "I know, personally, she regrets saying what she said," McBride told the CP. "The interviewer obviously got Chantal on a bad day."

They claim that a small part of the lyrics are the same and are saying that I took these from them. I had never heard this song in my life and their claim is based on five words! All songs share similar lyrics and emotions. As humans we speak one language.

Ummm... in this case, the language is English, and no, we don't all speak English.
